Terms and Conditions.

These terms govern your use of our website, facility, memberships, assessments, services, and programs.

Institute for Human Optimization DBA Longevity Gyms is a physician-led performance medical center. In these Terms and Conditions, “Longevity Gyms,” “we,” “us,” and “our” refer to Institute for Human Optimization DBA Longevity Gyms.

These Terms form a legally binding agreement between you, whether acting personally or for an entity, and Institute for Human Optimization DBA Longevity Gyms. By accessing the website, creating an account, submitting a form, purchasing or booking a service or product, enrolling in a membership or program, electronically accepting an agreement, or entering our facility, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the website or services.

Separate membership agreements, informed-consent documents, screening forms, payment authorizations, notices, and waivers may also apply and are incorporated when presented and accepted. If a signed or electronically accepted agreement conflicts with these general website Terms, the more specific agreement controls to the extent permitted by law.

Section 01

Eligibility, Screening, and User Representations

Our services are intended for adults age 18 and older unless we expressly approve otherwise in writing and obtain all legally required consent. By using the website or services, you represent that you have legal capacity to agree to these Terms; the information you provide is accurate, current, and complete; your use is lawful; you are not impersonating another person; and you will not access our systems through unauthorized automated means.

You agree to provide complete and accurate screening information and promptly disclose changes in your health, medications, pregnancy status, implanted devices, symptoms, or other circumstances relevant to safe participation. We may require medical clearance, modify or decline a service, or stop a session when proceeding may be unsafe or inappropriate. Eligibility for one service does not establish eligibility for another.

Section 02

Medical Relationship and Informed Consent

Institute for Human Optimization DBA Longevity Gyms is a performance medical center. Certain testing, consultations, therapies, and protocols may constitute medical services when ordered, supervised, or delivered by a licensed healthcare professional. Other performance, recovery, and educational services may be nonclinical. We identify the nature of the service and any clinical requirements during screening and consent.

A physician-patient or other clinician-patient relationship is created only through the appropriate intake, acceptance, evaluation, and consent process. Browsing this website, contacting us, submitting a form, or entering the facility does not by itself create that relationship.

Medical services are governed by applicable informed consents, our Notice of Privacy Practices, professional standards, and individualized clinical judgment. General website content and nonclinical staff communications are not individualized medical advice.

Emergency care: Longevity Gyms is not an emergency department and does not provide emergency services. Call 911 or seek immediate medical care for an emergency.
Section 03

Accounts and User Data

You agree that information supplied to us is accurate, current, and yours to provide. You are responsible for safeguarding login credentials, confirmation links, and devices used to access our systems and for activity occurring through your account. Notify us promptly if you believe your account or information has been used without authorization.

We maintain data submitted through our systems as described in our Privacy Policy and, where applicable, HIPAA Notice of Privacy Practices. You are responsible for retaining copies of nonmedical materials you need. Nothing in these Terms permits us to disclaim duties imposed by HIPAA, Maryland medical-record law, or other applicable privacy and record-retention requirements.

Section 04

Bookings, Preparation, and Attendance

Services are subject to availability, screening, equipment readiness, staffing, and facility operations. Arriving late may shorten or forfeit a session so that later appointments are not disrupted. Failure to follow preparation instructions may affect safety or measurement validity and may require rescheduling.

Unless your purchase terms state otherwise, one reschedule is permitted when requested at least 48 hours before the appointment. Late cancellations and missed appointments may be forfeited. We may waive or modify these rules where required by law, when we cancel, or when our team determines that a service cannot be safely performed.

Section 05

Payments, Packages, and Refunds

Prices, inclusions, expiration dates, taxes, and payment schedules are disclosed at purchase or in the applicable agreement. You authorize us and our payment providers to charge the payment method selected for amounts then due, including recurring charges you have expressly authorized.

Except where the purchase terms or law provide otherwise, completed services, missed appointments, late cancellations, deposits, testing appointments, and partially used packages are nonrefundable. Packages and credits are personal and may not be transferred, resold, or shared without written approval.

If we cancel a service and cannot provide a reasonable rescheduling option, we will provide the remedy stated in the applicable agreement or required by law. Nothing in this section limits a nonwaivable consumer right.

Section 06

Programs, Memberships, and Recurring Billing

The agreement accepted at enrollment governs the program or membership term, included services, clinical components, usage limits, billing date, renewal provisions, cancellation procedure, and any minimum commitment. Access is personal and cannot be shared.

Services included in a program or Circuit remain subject to clinical appropriateness, screening, equipment availability, and professional judgment. Purchasing a program does not guarantee that every listed service will be appropriate for you. When necessary, our clinical team may substitute, postpone, modify, or decline a service consistent with the applicable agreement and standard of care.

Where recurring billing is authorized, charges continue according to the signed agreement until properly cancelled. A failed payment may result in a retry, suspension of access, and reasonable collection activity permitted by law. Changes to pricing or material terms will be communicated using the notice required by the agreement and applicable law.

Products

Retail Products

If we offer retail products, descriptions, images, specifications, pricing, and availability may change and may contain inadvertent errors. Screen displays may not reproduce colors exactly. We may limit quantities, reject suspected resale orders, correct pricing errors, or discontinue a product, subject to applicable law.

Product purchases are subject to the return, shipping, storage, and use instructions disclosed at purchase. Supplements and other wellness products are not substitutes for medical care. Use products only as directed and disclose relevant medications, allergies, and health conditions when clinical review is required.

Section 08

Facility Conduct

  • Follow staff instructions and posted safety rules.
  • Do not operate equipment without authorization or orientation.
  • Stop immediately and notify staff if you feel unwell.
  • Do not attend while impaired by alcohol, recreational drugs, or any substance that makes participation unsafe.
  • Treat staff and guests respectfully and do not harass, threaten, or disrupt others.
  • Do not photograph or record another person without consent.
  • Secure personal belongings; we are not responsible for loss or theft except where liability cannot legally be excluded.

We may refuse service, remove a person, or suspend or terminate access for unsafe, unlawful, abusive, fraudulent, or materially disruptive conduct, subject to applicable law and contract rights.

Section 08

Risks, Safety, and Informed Participation

Exercise, physiologic testing, heat, cold, pressure, compression, oxygen-related environments, electromagnetic fields, light-based services, infusions, injections, and other services offered at the center involve inherent and service-specific risks. These may include dizziness, fainting, discomfort, skin reactions, bruising, infection, muscle or joint injury, changes in blood pressure or heart rate, medication or infusion reactions, adverse physiologic responses, and, in rare circumstances, serious injury.

Risks, benefits, alternatives, contraindications, and reasonably available options for a medical service will be addressed through the applicable informed-consent process. You agree to follow instructions, disclose relevant information, and immediately report pain, dizziness, shortness of breath, distress, or an unexpected reaction.

Section 10

No Guarantee of Results

Individual responses vary. We do not guarantee a health, fitness, aesthetic, performance, recovery, weight, longevity, or financial result. Measurements may vary with device conditions, preparation, hydration, effort, timing, and ordinary biological variability.

Scientific research or manufacturer information presented on our website is educational context. It does not establish that a study’s findings apply to you, that our protocol duplicates the study, or that a specific result will occur.

Section 11

Website License and Prohibited Activities

Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access the website and print reasonable portions of its content solely for your personal, noncommercial use.

You may not scrape or systematically collect data; use bots, scripts, or unauthorized automation; bypass access or security controls; introduce malicious code; overload or disrupt our systems; impersonate another person; obtain account credentials; submit false or unlawful material; harass staff or users; infringe privacy or intellectual-property rights; frame the website without permission; reverse engineer software except where law expressly permits; remove proprietary notices; use content to compete with us; resell access; or use the website or services for an unlawful or unauthorized purpose.

We may investigate suspected misuse, preserve relevant records, restrict access, and cooperate with lawful requests from regulators or law enforcement.

Section 12

Intellectual Property

Our website content, brand elements, written materials, graphics, photographs, protocols, Circuit concepts, and other original materials are owned by or licensed to the Institute for Human Optimization and are protected by applicable intellectual-property law. You may not copy, reproduce, publish, distribute, sell, reverse engineer, or create derivative commercial materials without prior written permission.

Third-party trademarks and product names belong to their respective owners. Reference to a third party does not imply sponsorship or endorsement unless expressly stated.

Submissions

Submissions, Reviews, and Feedback

You retain ownership of original content you submit. You represent that you have the right to provide it, that it is accurate to the best of your knowledge, and that it does not violate law or another person’s rights. Do not submit another person’s health information, image, or private information without authorization.

When you voluntarily provide nonconfidential suggestions, ideas, reviews, or feedback, you grant us a worldwide, nonexclusive, royalty-free license to use, reproduce, and adapt that material for lawful business purposes. We will not publicly use patient testimonials, identifiable health information, photographs, or recordings without any authorization or consent required by law.

Section 13

Third-Party Platforms and Links

Scheduling, communications, payments, forms, and other functions may be provided through third-party platforms. Their availability, security, and separate terms are controlled by those providers. Links to external websites are provided for convenience and do not make us responsible for their content, services, or privacy practices.

Section 14

Privacy, Email, and SMS Messaging

Our collection and use of personal information is described in our Privacy Policy. Protected health information is addressed in the Institute for Human Optimization’s HIPAA Notice of Privacy Practices. Those notices are incorporated into these Terms by reference where applicable.

If you provide the required consent, we may send nonmarketing texts concerning inquiries, forms, scheduling, confirmations, reminders, service instructions, and account support. If you separately consent to marketing, we may send promotions, offers, updates, and event information. Consent to marketing is not a condition of purchase or care.

Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. An opt-out may not prevent communications required to complete a transaction, protect safety, or satisfy legal obligations when another lawful channel is used.

Access

Service Management, Suspension, and Interruptions

We may monitor our website for compliance, correct errors, update content, restrict unlawful or abusive activity, suspend an account, refuse a transaction, or terminate access for a material breach of these Terms, fraud, safety concerns, nonpayment, or unlawful conduct. Termination does not eliminate payment or other obligations that accrued before termination.

Website features, equipment, clinicians, staff, products, and services may be unavailable because of maintenance, repairs, technology failures, supply constraints, emergencies, safety concerns, or circumstances beyond our reasonable control. We may modify, substitute, suspend, or discontinue an offering. Any credit, rescheduling, or refund will be governed by the applicable purchase agreement and law.

We may correct typographical errors, inaccurate descriptions, availability information, and pricing mistakes. If a material pricing error affects a completed purchase, we may contact you to obtain approval of the corrected price or cancel and refund the affected purchase.

Disclaimers, Liability, and Indemnification

To the fullest extent permitted by law, the website and its general informational content are provided “as is” and “as available.” We do not warrant that website content will be uninterrupted, error-free, or suitable for a particular nonclinical purpose. This website disclaimer does not alter the professional standard of care applicable to medical services.

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from website use or a breach of these Terms. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable professional duties, gross negligence, willful misconduct, or nonwaivable consumer rights.

You agree to indemnify and hold Institute for Human Optimization DBA Longevity Gyms and its officers, employees, and agents harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the website, your material breach of these Terms, content you submit without required rights, or your infringement of another person’s rights. This provision does not require you to indemnify us for our own negligence, professional malpractice, or unlawful conduct.

Electronic Records

Electronic Communications, Transactions, and Signatures

You consent to conduct transactions electronically where permitted by law. Electronic signatures, checkbox acceptances, records, notices, disclosures, payment authorizations, and agreements may have the same effect as paper documents and handwritten signatures. You are responsible for providing a working email address and telephone number and for maintaining access to the devices needed to receive records.

You may request a paper copy of an electronically signed document by contacting us. Any right to withdraw consent to electronic records, and any resulting effect on online services, will be provided when required by applicable law. Clinical consent may not be inferred merely from general website use and must be obtained through the applicable consent process.

Section 16

Disputes and Governing Law

Please contact us first so we have an opportunity to address a concern. These Terms are governed by Maryland law, without regard to conflict-of-law principles. Unless a signed agreement lawfully provides otherwise, an action relating to these Terms shall be brought in a court of competent jurisdiction serving Anne Arundel County, Maryland.

If any provision is held unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.

General

General Provisions

These Terms, together with the Privacy Policy, HIPAA Notice of Privacy Practices where applicable, and any accepted service-specific agreement, constitute the applicable agreement between you and us concerning their subject matter. Headings are for convenience only.

We may assign our rights and obligations in connection with a merger, reorganization, financing, sale, or transfer of the business, subject to applicable privacy and healthcare laws. You may not assign your rights under these Terms without written consent. No partnership, joint venture, employment, or agency relationship is created by website use.

We are not responsible for delay or failure caused by events beyond our reasonable control, but this does not excuse duties that cannot lawfully be waived. If any provision is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remainder will continue. Failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination will survive.

Section 17

Changes to These Terms

We may update these Terms and will revise the effective date when we do. Material changes affecting an existing membership or recurring payment will be communicated as required by the applicable agreement and law. Updated website Terms do not retroactively replace a signed agreement unless the agreement or law permits that change.
